None of the people who came across the border from the US are refugees. If they were, they would have asylum in the US and thus would have no reason to jump the border into Canada.
Yeah, the biggest policy failure is the loophole in the safe third country agreement that says you're not allowed to claim asylum at the Canada/US border (since if you have a valid asylum claim, you can claim it in the country you're already in and thus have no reason to cross the border). The problem with that treaty is that language didn't account for people who jump the border illegally.
So all you gotta do is jump the border somewhere away from an official border crossing, and once you've got both feet firmly planted in Canada, you're not claiming asylum "at the border" anymore, you're claiming it in Canada which is allowed.
Thankfully the CPC have pledged to close that loophole if they get elected. All it does is incentivize illegal Can/US border crossings by people who are illegally in North America to begin with.
