This makes immigration to Canada easier for migrants claiming asylum. If you cross from the USA and apply for asylum in Canada (even if you entered the USA illegally and even if you are a criminal there), you cannot be deported back to USA.

The Court ruled that since certain refugees "are immediately and automatically imprisoned by US authorities" after custody is transferred from Canada, Canadian authorities are complicit in the violation of "the spirit and objective of the STCA and are a violation of the rights guaranteed by section 7 of the (Charter of Rights and Freedoms)."

This court has ruled, and in practice, has changed how asylum applications will be decided. Canada is not legally allowed to be complicit in actions that are illegal in Canada that take place outside of Canada.

basically America is a shit hole and because america is a shit hole and no longer seen as a safe place, that act no longer has validity.

Unfortunately "our constitution" is not a single document. In the same way that British law is decided by cases (not statute), "our constitution" is a series of legal documents and interpretations and is not so plainly defined as the USA.

The reality is that legal authority and rights in Canada are derived from the divine right to rule of the sovereign, which is only another way of saying anything goes unless power is leveraged by the people and the courts onto the government.

All that said, no where in our various constitutional documents does Canada have sovereignty or responsibility over non-Canadian citizens. That is unless you (or courts) consider foreign treaties to be constitutionally binding, in which case, our constitution would also be made up of ratifications of agreements with foreign bodies.
