As an oil & gas worker who has had to wear PPE for decades, and now as a manager who has to enforce PPE rules on others, I don't think you have a leg to stand on. LOTS of what what we do in O&G in terms of safety is bullshit. Our mantra is even one incident, even one band-aid is too many. I think wearing a hard-hat and safety glasses & fire-retardant coveralls while walking through an empty field that just happens to be classified as a 'work site' is ridiculous. And I have been disciplined many times for not wearing that shit when I thought it was ridiculous. From a corporate point of view, however, they don't give two fucks about your safety or comfort or opinions, it is just about the bottom line. If wearing safety glasses in a field prevents one idiot from filing a WCB claim after he gets a bit of pollen in his eye, they see it as a win.
If you just want to be a pain in their cunt, put on a REAL mask, an N100 or whatever with rubber skin seals, get it fit tested, and take a day-long industry certified course on how to use it. Have your fit-test and training certificate in your pocket, do your shift, wait for some sort of egregious mask-wearing incident, and then invoke your right to refuse unsafe work. LOCK THE DOOR and demand that Smitties shuts the location down until everybody has proper safety training regarding mask usage and industry certification. Demand that everybody shaves their beards for an efficient seal and gets a proper fit-test.
Even if you win, you still lose. But you would open up a whole can of worms. In O&G we require about a week of safety training before ANYONE can even step foot on a drilling location. That includes minimum wage roughnecks and truck drivers and the like. The safety onboarding costs of a new employee are a minimum of $10,000. The idea that Walmart and McDonalds and Smitties need to give every minimum-wage employee $10,000 in safety certifications would shake the fucking world. You would open up the idea that religious minorities would have to shave for safety (which there is already precedent for in O&G because of H2S). You could take that shit right to the supreme court if you had enough money and legal backing.
