That's not how our constitution works. Even private businesses can be sued for enacting practices on their patrons or employees that go against the spirit of the charter. The charter is more than just the bold text. The preamble confers many rights not enumerated in the charter.

The government knows this is unconstitutional. Still more than a year later the government has yet to be made accountable in any court. They can lie bold faced to the public but not in court.

The Justice Centre for Constitutional Freedoms has ongoing or pending court actions in five provinces to end the Charter-violating lockdowns.

The Alberta government engages in the same stonewalling in the Court of Queen’s Bench, where a Charter challenge to the lockdowns was filed in December of 2020. The Alberta government sought and obtained the court’s permission to delay filing scientific evidence until July of 2021.
