I'm just doing quick searches in the act's text, but I can't find any statement on those younger than 16 being able to consent. Only many instances of being able to consent after "attaining 16 years of age."
There may be a bullshit argument that I've seen elsewhere that if the child is at school, that means the guardian has consented, even without a notice being sent out or a document signed.
