The judge provided an overview of Marshall’s troubled background after reviewing a number of documents, including a Gladue report provided by Aboriginal Legal Services.

Goldstein stated he is aware that Marshall has been subject to systemic racism all his life as an Indigenous person.

He received a lighter sentence for his first break and enter beating because of his race, the system is not racist towards him but to his White victims that should have been protected from him. While on bail and parole because of his Native privilege he beat a White 82 year old grandmother to death.
