The original court finding was yelling it "falsely" in order to create panic. Not to mention the original decision was an opinion in the US courts back in1919 over speaking out against the draft and was partially overturned in 1969 and limited in scope to speech that "directed to and likely to incite imminent lawless action" aka riots, etc. So basically this shows he knows nothing about what he's talking about.
