Lawyer here. Just to add some context. If I was representing an entity, such as Canada, in a trade negotiation, and I didn't strongly advise my client to fight this tooth and nail and to invoke the dispute clause, my client would be able to both sue me for negligence, and make a complaint to the law society, where I would be found guilty of violations. I can tell you, unequivocally, that lawyers were involved in this correspondence. So either the lawyers just happened to be negligent as fuck, or the gov't of Canada received all the necessary information and chose not to exercise their rights to the prejudice of every fucking Canadian citizen.
