The thing is, they did go to court and they won. The treaty allows them a "modest income" from fishing which means they are allowed to catch and sell. The real problem is that the federal government has done nothing to define what a modest income means nor establish any regulations as to how to fish while maintaining the stocks.
All that said, the lobster fishery the Mic'maw are engaging in is outside of the DFO season and there is no way to know if they are following any regs with regard to size or number, or really anything. The commercial fishermen are pissed because this directly impacts their livelihood and especially so in a pandemic. I'd be pissed, too. The feds need to get this fixed.
