As far as I know the notwithstanding clause can only be used for some sections of the Charter. And the mobility rights of Canadians, which are in section 6 of the Charter, are inviolable.
Yes. The notwithstanding clause allows governments to pass legislation which would otherwise breach certain sections of the charter. It doesn’t give the federal government power to legislate in areas granted to the provinces.
So that would mean then that the provincial governments don't have the authority to quarantine healthy people either then? As mobility rights of Canadians are guaranteed in the Charter. Yet they are doing it anyways. lol. At least 7 provinces (representing at least 50% of Canadians) agreed to the Charter. So the provinces have to follow the Charter too if I'm not mistaken.
Nope. Provinces and feds have different kinds of authority. The feds can only quarantine people which come into Canada, but they can't restrict travel within a province or between provinces. But provinces have through Section 1 of the Charter a way to restrict travel within their borders and thus override Section 6 of the Charter.
