School board, Ontario, Unvaccinated person
"mandatory" rapid testing done at home 3x a week ONLY for the unvaccinated staff; kits provided by the school board
kid in class positive case so the whole class and staff sent home
the vaccinated staff are allowed back to work the next day, no testing of any kind required
the unvaccinated must provide TWO negative PCR tests before allowed back to work
MY QUESTION: Case for Discrimination? We know the vaxxed can contract and also spread covid19, so why no testing for the vaxxed at any time and also now with the kid in class as a positive case still no test required?
I am not a lawyer, but this appears to me as discrimination
Thoughts?
you’re right! but unfortunately it’s not legally discrimination .., It’s only discrimination if you are a “protected class” (Based on gender, race, age, religion etc) not your vaccine status. Unfortunately. Maybe if you had a disability which prevented you from getting the vax…
Canadian human rights act note:Prohibited grounds of discrimination
3 (1) For all purposes of this Act, the prohibited grounds of discrimination are race, national or ethnic origin, colour, religion, age, sex, sexual orientation, gender identity or expression, marital status, family status, genetic characteristics, disability and conviction for an offence for which a pardon has been granted or in respect of which a record suspension has been ordered.

Ontario human rights “takes the position that mandating and requiring proof of vaccination to protect people at work or when receiving services is generally permissible under the Human Rights Code (Code) as long as protections are put in place to make sure people who are unable to be vaccinated for Code-related reasons are reasonably accommodated. This applies to all organizations.”
“Upholding individual human rights while trying to collectively protect the general public has been a challenge throughout the pandemic. Organizations must attempt to balance the rights of people who have not been vaccinated due to a Code-protected ground, such as disability, while ensuring individual and collective rights to health and safety.”
