Just the Liberal using the courts/tribunals/commissions to 'force' them to do what they are going to do anyway, yet again. This endless litigation is not justice and is never as clear cut the press would have us believe. It's not this particular case that upsets me. It's that next month it will be a new case where another unelected official will force billions to be spent on some other useless ideological project.
Further, all this will not help anyone. Aboriginals will continue be told that they are nothing but victims and all their problems are the government's fault. The government will continue to reduce individuals to members of racial/ethnic/linguistic/gender groups and to pit these groups against each other. It's the opposite of reconciliation and opposite of good government.

Do you think a conservative government would have meant a different outcome in the courts?
I hope that they would. But you are right: the Conservatives and Liberals are largely the same party in different clothes.
Or maybe the courts are separated a bit from the government of the day. Maybe they tend to look at the actual agreements and the relevant laws.
Who knows? The Supreme Court of Canada may not actually take direction from the Prime Minister.
The government was the defendant. They wanted to loose. They made sure that they did. But the real losers are Canadians, both aboriginal and not.
