Doesn't the non-withstanding clause allow the government to basically wipe their ass with the Charter though?
The British Commonwealth (New Zealand has the most cucked lockdown) and Europe doesn't respect civil liberties to the extent that the United States of America's constitution does. Except for Sweden and maybe Switzerland?
And even Sweden's Prime Minister is starting to cuck with their new restrictions. He ignored the recommendation of the state epidemiologist Dr. Anders Tegnell to keep regulations loose.
Yeah I agree that the Supreme Court of Canada and of each province should challenge these lockdowns. Even if parliament at the federal and provincial levels have to pass legislation invoking the non-withstanding clause to bypass the courts. Canadians need to realize how bad the non-withstanding clause is. Most Canadians aren't even aware that we have this tyrannical clause.
We took Civics in Grade 10 (not sure if that's junior high or just high school). I can't recall if they taught us about the non-withstanding clause. I found out about it online awhile back. I have seen leftists bitch about the non-withstanding clause when Doug Ford threatened to use it in 2018. But you won't see any leftists bitch about it if non-withstanding clauses were used to uphold lockdowns and gathering restrictions.
These challenges happen or already happened.

As u/NoStepOnMe states, the notwithstanding clause has to be explicitly invoked in order to fromally suspend any of those rights.
What really makes the charter legally worth about much as a piece of toilet paper is the fact that our sham of a supreme court can just go along with any abuse that a government chooses to undertake and there's nothing anyone can do about it. Knowing this, the government can and does just trample our rights with complete abandon as if the charter doesn't even exist, because for all intents and purposes, it doesn't.
Yep... “supreme court go along with any abuse that a government chooses”. Is it because the same people that control our government controls the supreme court?
Canada is so deeply controlled with corruption our only hope is Trump wins and exposed the corruption with the voting machines and shows the people how far reaching this scam has gone.... world wide.
Voting machines made in Canada and programmed in Venezuela using Bill Gates Windows platform. Voting data is upload to Germany and god knows what happens there. Tin foil hat is sparking now...
This is part of the reason I posted this. I heard the same about ‘wiping their ass’ with the Charter. Where are the smart people who can break this down for us?
https://laws-lois.justice.gc.ca/eng/const/page-15.html
Meaning, all the rights "guaranteed" are limited to what the gov/courts think is "reasonable" and can be suspended whenever they feel like it
So our only hope is to appoint new judges like Trump did? Over 200 state judges and 3 Supreme Court justices. So in other words we got nothing?
Yup. If I were a judge I’d be very, very strict in interpreting section 1. But most judges in Canada would likely give the government the benefit of the doubt and allow the abrogation of rights on a public health or similar basis.
If Trudeaus minority government holds till 2023, he will appoint another 2 Supreme Court justices. In July 2021 a judge will have to retire and another in December 2022. This means that 5 of the 9 judges will have been appointed by Trudeau.
And the "great" thing is that the next government who ever it will be, will have no Supreme Court appointments till 2028.
Man... if that’s true, Canada is in serious trouble. Should almost make another thread on Supreme Court appointments. We gotta share are much info as possible
There is no if. It is true.

Dang... freaking ridiculous! Once Trump wins exposing the election fraud and the dominion machines we can start to investigate Canada after.
Exactly. I also seem to recall there are no property rights for Canadians either.
New Zealand is COVID free, and has largely returned to normal life.
Who's the cuck now?
New Zealand had to reintroduce restrictions when they imported the virus back into their country. Even if those restrictions are gone now (they only have 4 cases/day), the restrictions will return when more travel-related cases get imported into the country. New Zealand is also a small island nation of like 5 million people.
This new normal for New Zealand still sucks. Their tourism industry is completely gone now. And New Zealanders can't travel outside the country without going into cuck quarantine when they return.
If you want to eat the shit out of Jacinda's asshole, be my guest.
Just gave me a half chub there bud.
Triggered much?
Interesting. I kinda figured that. Have you ever heard of A Warrior Call’s Christopher James. Or Doug Force? These guy are looking to fight for our freedoms https://awarriorcalls.com/a-warrior-calls-landing-page/
Here is Doug Force’s website https://www.themythiscanada.com/
Absolutely! Rocco is not scared to fight! Good mention!
Lawyer here. This isn't a good post.
First, lets start from the top. You're using section 2 and 7 to absurd levels that may benefit you in this instance, but trust me, you do NOT want that broad use of section 2 (maybe section 2(b) we can leave without limits, but TRUST ME you do not want religions getting more rights under 2(a).
Now your section 2b I(i'm assuming you're not arguing freedom of religion) argument is entirely useless. There's no section 2 argument on any of the items you mentioned.
Section 15 could apply for masks and someone with a disability. That is IT. Section 8 and 9 isn't violated.
Now section 7 you may have something. You could potentially add a section 7 argument to a disabled person (could actually violate both) forced to wear a mask if there are physiological consequences.
So why would manditory vacines violate 2 (retarded) and not section 7 (actually a STRONG section 7 argument)? This makes the entire post clearly written by a half retarded person that has never entered a court room before. Literally your strongest argument by far would be compelled vacines as a s 7 violation. I'd bet that would actually win, yet it's not even on there. Furter, closure of business and churches would potentially violate 7 and 2b respectively.
Everything else is nonsense. But what do I know, I'm just a full time barrister.
Lol! I was hoping someone with REAL knowledge would show up here and separate the men from the boys. The community is growing here and it’s pool of knowledge to bounce stuff off that’s way over my head.
I think we are all looking for the magic answer of how we can defend our freedoms against the lies. I guess every case is different and there is no easy answer. But what do I know.... I’m just a freedom loving Canadian that’s had the wool pulled over my eyes for too long! Cheers ?
Yeah sorry bro, no disrespect meant at all, just offering a legal opinion. TBH there is a charter argument, but section 7 and vacines is by a large margin the strongest one. Based on what I know about section 7 (minimal, I'm a commercial litigator), I think that this argument would pass. But we have to be careful since the charter essentially fucks conservaatives 98% of the time, so we don't want too much caselaw to strengthen it, know what I mean? You literally have a constitutionally enshrined act that allows racism towards white males. Lets try and get rid of it, rather than strengthen it. We never needed the charter, the BoR covered the field adequately. Some of the most frustrating decisions in Canadian history are due to the charter. Sorry, rant over. Cheers.
None taken! You’re in-site is extremely valuable. I assume everybody here has a different skill set. Together we might actually get somewhere in this clucked country.
I operate a business so I see first hand the red tape thrown at us from the government. You see the actual laws behind that red tape. Most people are too busy to make a difference, but these bullshit lock downs are giving us that time!
Section 7 - "security of persons" is what would be violated by mandatory vaccines right? It's something like bodily integrity if I understand correctly.
Exactly.
As I wrote below, I suspect most judges in Canada would likely accept a s. 1 argument justifying curtailing certain rights because of the pandemic. They would likely give the government the benefit of the doubt and allow the abrogation of rights on a public health or similar basis. I wouldn’t if I were a judge. But judges are largely not a conservative group. That would make sustaining any argument under ss. 2 or 7 very difficult.
I agree, hence why most if not all of them would fail.
"Charters" don't mean shit when they aren't enforced.
There is systemic racism in Canada, this much is true.
The 'systemic racism' happens to be the intersectionality/'Diversity is our Strength/Islamophobia/etc
Every institution in Canada has swallowed this like a load of hot cum.
Laws-lois.justice.gc.ca/eng/const/page-15.html
Take it to court and you'll get section-oned.
The charter isn't worth the paper it's printed on.
Super relevant document for when the cops start fining and arresting you like they're doing in Australia.

How to sue the Police and Private Security in Small Claims Court
http://www.accessjustice.ca/downloads/HowtoSuethePoliceandPrivateSecurityinSmallClaimsCourt.pdf
I believe the book is based on your rights.. its been a while since I read it.. probably good idea to refresh my memory.
I think you missed the part in section 1. "within reasonable limits". I don't disagree with you, but what I think is irrelevant. Whaat matters is what the guy setting "reasonable limits" thinks.
It amazes me how willing Canadians have been to give away their civil liberties over a virus where the median age of those who die with it are 84. Laws-LOL-Justice infuckingdeed. Our country is a fucking joke. When Doug Ford is like "if you don't like Canada, leave." I might just take him up on that offer. Because my parents are Portuguese so I'm eligible for Portuguese citizenship. That means I can live and work anywhere in the EU. Europe is full of cucks too now but there's gotta be at least one EU country that is less cucked than Canada.
I told my dad about the guy in Kelowna, BC who got fined $3,000 for having a poker game in his house with 9 people. And he's like "Doug Ford should do that in Ontario." My dad is a 72 year old retired man with no life who is terrified of WuFlu so he's totally okay with locking everyone else down, including me, because this is a civil liberty he doesn't take advantage of. This guy fled Portugal under the Estado Novo regime in the 60s to escape fascism for "liberdade". And yet he wants to go along with authoritarianism in Canada? Disgraceful. People like this are the reason why our country is going to shit.
This is a Tory in the 905. Not a Liberal. He literally doesn't give any fucks about all the people who had their lives destroyed by lockdowns. My girlfriend has been unemployed since the lockdown and he told me to dump her, don't date a loser. Meanwhile she's unemployed due to lockdowns to pacify terrified geriatrics like my pops. My dad is a literal boomer meme. Even though I know some boomers and Silent Gen who think this lockdown is horse shit. This virus is more of a Silent Gen Remover than a boomer remover too. I think Silent Genners are less terrified of this than boomers even though they are the main target of this virus. Because they are more accepting of their impending mortality.
I agree with lots you said there. But I refuse to give on on Canada. Sometimes I think we have a silent majority in Canada that has been censored hardcore. I watched the awakening happen across the USA and it was a slow go to break through all the censorship. The USA had some BIG players to help break thought the censorship. In Canada the same movement is having trouble breaking through to the masses. I can see the independent media in Canada growing but our country is sooooo big its hard to organize rallies to show people the numbers behind this movement. If Trump did have rallies we would have NEVER seem the support. The rallies were key!
The thing that gives me hope is seeing the Pro-lockdown videos in Canadian media YouTube channels having a high dislike:like ratio and lots of redpilled comments sections. But then I see NBC News or MSDNC's YouTube videos or the Young Turks and they have a high like:dislike ratio.
I wonder if the liberal news media has bots on their YouTube channels liking the videos. And if they delete comments.
The funny thing is how the liberal media gaslights us and says that it's Russian bots who are downvoting Trudeau and pro-lockdown content. And redpilling in the comments sections. As if we got all of our opinions from Russian bots. No, I want my fucking freedom. I was not manipulated by conspiracy theorists or Russian bots to want my fucking freedom. It's the people who want to give away their civil liberties to Big Daddy Government who are the brainwashed ones. I feel sorry for the people who die from COVID. But I want to live my fucking life too. And living my life is more important than 84 year olds dying with COVID. I'm sorry if that makes me a heartless autist lacking in empathy. I just don't feel the same like all the virtue signaling cucks in this country. And it wasn't Russian bots or conspiracy theorists who made me feel this way.
When ESPN was doing woke BLM shit, I got shadowbanned from their channel on YouTube after redpilling in the comments section.
Preach my brother! Preach! ?
Stuff's cheap in Portugal. Wine, Olive Oil...
I think a lot of Canadians don’t know any better. You only know what you’ve been taught. I find it hard to not get pissed at clucked Canadians but I remember when I didn’t know any better either. When you see the truth it can’t be put back in the bottle. Everyone wakes up with a different truth. We have to help our fellow Sheeple how to see the truth. The government news in Canada has cast a spell over its people and we need to break the spell!
Yup. I got shit the other day because some guy was freaking out over the restrictions at some Costco in Manitoba. I reminded him the gubmit decided to take our guns away in May, and I didn't hear too many complaints on this forum.
